Terms of Service.

By accessing or using nexqual.com and related services (the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into a contract to use the Service. By using Nexqual, you represent that you meet these requirements and that all information you provide is accurate.

• You are responsible for your account, your username, and all activity that occurs under it.
• Keep your password confidential and notify us promptly of any unauthorized use at support@nexqual.com.
• Choose a username that is not misleading, impersonating, or offensive. We may reclaim usernames that violate these terms.
• One person may not maintain multiple accounts to manipulate discussion, votes, or visibility.

To keep Nexqual trustworthy, you agree not to:

• Post or promote market manipulation, including pump-and-dump schemes, coordinated “ramping,” or knowingly false or misleading statements about a security.
• Share unauthorized inside information or anything that would breach securities law in your jurisdiction.
• Impersonate any person, company, or Nexqual itself, or misrepresent your affiliation.
• Post spam, scams, malware, or unsolicited promotions, or operate bots without our permission.
• Harass, threaten, defame, or post unlawful, hateful, or infringing content.
• Use direct messages, group chats, or shared media to send unlawful content, non-consensual intimate images, content that sexually exploits or endangers a minor, harassment, spam, scams, or malware.
• Scrape, reverse-engineer, overload, or interfere with the Service or its security.

We may remove content, suspend, or terminate accounts that violate these rules, and may report unlawful activity to the appropriate authorities.

You keep ownership of the content you post. By posting, you grant Nexqual a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Service. You are responsible for what you post and confirm you have the right to post it.

The Service includes private messaging, group chats, and the ability to share photos, images, and files with other users. You are responsible for everything you send and for the content of any group you create or join. Do not share other people’s private information without their consent. Messaging is provided “as is,” and we are not responsible for content exchanged between users.

To keep the Service safe, we may review content that is reported to us, remove content, and suspend or terminate accounts that break these terms. We may also preserve and disclose content where we believe it is necessary to comply with the law, respond to legal process, or protect the rights and safety of users or the public.

We do not routinely monitor the content of private messages, and we are not obligated to pre-screen content. You can report abusive messages or users and block other users at any time; please report serious abuse to support@nexqual.com. If you create or administer a group, you are responsible for helping keep it within these terms.

Zero tolerance for child sexual abuse material. Any content that sexually exploits or endangers a minor is strictly prohibited anywhere on the Service, including in private messages and groups. We will remove such content, terminate the accounts involved, and report it to law enforcement and the appropriate authorities (such as the National Center for Missing & Exploited Children), as required by law.

The Service relies on third parties — including Google (sign-in), Supabase, Cloudflare, and market-data providers — and may link to third-party sites. We are not responsible for the content, accuracy, or practices of third parties, and their use is governed by their own terms.

The Service and all data are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data will be accurate or timely.

To the maximum extent permitted by law, Nexqual and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or trading losses, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the prior twelve months or USD 100.

You agree to indemnify and hold harmless Nexqual from any claims, damages, or expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these terms or any law.

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you violate these terms or to protect the Service or other users. Sections that by their nature should survive termination — including content license, disclaimers, liability limits, and indemnification — will survive.

These terms are governed by the laws of the jurisdiction in which the operator of Nexqual is established, without regard to conflict-of-law rules. Nothing in these terms removes protections you cannot waive under the law of your home country or state. If you are a consumer in the European Economic Area, the United Kingdom, or a U.S. state with mandatory consumer-protection laws, you keep the mandatory rights of, and the right to bring proceedings under, the laws of your country or state of residence. The parties will try to resolve any dispute informally by contacting each other before starting formal proceedings.

We may update these terms from time to time. When changes are material, we will update the “Last updated” date and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance of the updated terms.
